In exchange for participation in any physical activity, sports training, social or other event ("Activity"), organized by APEX VOLLEYBALL LLC, its employees, representatives, or agents ("Apex"), of 102 Duett Ct, Summerville, South Carolina, 29486 and/or use of the property and facilities located at 4115 Dorchester Road, Building 600, North Charleston, SC 29486 ("ApexHQ"), and services of APEX VOLLEYBALL LLC, I agree for myself, any minors for whom I am the legal guardian of, and any members of my party ("Participants"), to the following:

​Participants agree and allow Apex the use of their likeness in the present and future. This agreement extends to all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish the photographed likeness of Participants ("Likeness") that has been obtained pursuant to this policy.

The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising, and electronic publication.

Participants represent and warrant that (i) no other party has been granted the exclusive license with respect to Likeness, and (ii) no other party's authorization or consent is required with respect to the permission granted to Apex under this agreement.

Participants waive any right they may otherwise have to inspect or approve the Participants' Likeness, or the advertising copy or printed matter that may be used in connection with Participants' Likeness. Participants' releases Apex from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other related claim to the Likeness. This release includes without limitation any claims related to blurring, distortion, alteration, optical illusion, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of Likeness.
